A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. YOU MUST BE A LEGAL RESIDENT OF THE UNITED STATES AND 18 YEARS OF AGE OR OLDER TO ENTER. VOID WHERE PROHIBITED BY LAW.
GRAND PRIZE: $1,000 Home Depot Card issued by Home Depot retailer with locations throughout the United States (or a comparable gift card of equal or greater value). ("Grand Prize") Grand Prize merchandise may have to be purchased by the expiration date set forth on the Home Depot Gift Card or as otherwise provided at the time the Home Depot Gift Card is presented .
ELIGIBILITY: In order to enter the MCMILLIN Home Depot Card Sweepstakes ("Sweepstakes"), a person ("Entrant") must be a legal resident of the 50 United States and 18 years of age or older as of 2.12.10. Entry in the Sweepstakes constitutes the Entrant's full and unconditional acceptance of these "Official Rules." Any employee of MCMILLIN Homes, its subsidiaries or affiliates, or any other organization associated with the administration, prize support, advertising, fulfillment or promotion of the Sweepstakes and/or their respective agents, affiliates or subsidiaries, and any members of their immediate families or persons living in the same household is ineligible to enter the Sweepstakes.
SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:01 a.m. Pacific Standard Time ("PST") on 2.12.10 and ends at 11:59 p.m. PST on 2.28.10 ("Sweepstakes Period"). Winners will be selected randomly from entries properly submitted during the Sweepstakes Period. In order to be properly submitted, an entry must be in the form of one on of the two (2) methods listed below.
SWEEPSTAKES ENTRY INSTRUCTIONS: There are two (2) methods of entry into the Sweepstakes: online entry and U.S. Mail entry. Regardless of the method of entry, an Entrant may only enter the Sweepstakes one (1) time. In order to complete the online entry, an Entrant may complete and submit the online registration form during the Sweepstakes Period. That form is located at the following websites: www.PromoMcMillinHomes.com. All online entries must be received by the internet server at : www.PromoMcMillinHomes.com prior to the end of the Sweepstakes Period.
An Entrant may also enter the Sweepstakes by mailing a standard-size postcard containing the Entrant's name, address, city, state, zip code and phone number to: McMillin Homes, 5607 Avenida De Las Robles, Visalia, CA 93291 Attention: Sweepstakes. Postcard entries must be received prior to the end of the Sweepstakes Period to be eligible for the Grand Prize.
WINNER SELECTION AND PRIZES: The Potential Grand Prize Winner ("Potential Winner") will be randomly drawn under the supervision of a McMillin Homes administrator on 3.1.10 at 5:00 pm ("Drawing"). The odds of winning depend on the total number of eligible entries received. The Potential Winner will be notified by phone and/or email. The Grand Prize will be delivered on or about March 31st, 2010. McMillin Homes will determine all elements of prizing in its sole discretion. The Grand Prize may not be assigned, transferred, or changed, except at the sole discretion of McMillin Homes. The awarding of any prize is contingent upon full compliance with these Official Rules. By entering into the Sweepstakes, Entrants agree to be bound by these Official Rules and agree that if any Potential Winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, the Grand Prize will be forfeited and awarded to an alternate winner in a random drawing to be conducted in accordance with the rules set forth for the Drawing. Entrants understand that McMillin Homes is not liable for injuries, losses or damages of any kind arising from participation in this promotion or the acceptance, possession and use of any prize under these Official Rules. McMillin Homes is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Grand Prize. Decisions of McMillin Homes are final and binding in all respects.
PRIVACY POLICY: The website, www.McMillinHomes.com is owned and operated by McMillin Homes, located at 5607 Avenida De Las Robles, Visalia, CA 93291. McMillin Homes understands the need to safeguard sensitive information that you have provided and appreciates that you expect privacy and security for your personal and financial affairs. McMillin Homes attempts to minimize the information it collects to that which it reasonably believes is necessary in processing or administering a mortgage, home equity loan or providing products, services and other opportunities that may be of interest to you.
By entering the Sweepstakes and providing the required registration information, the Entrant opts into our "interest list" and thereby acknowledges that McMillin Homes may send information, samples or special offers it believes may be of interest to the Entrant about its products or other complementary goods offered by McMillin Homes. At any time you may have your name removed from the interest list by submitting an e-mail request to McMillinHomes.com and include “unsubscribe” in the subject line of your e-mail.
McMillin Homes maintains the right to change floor plans, elevations and features at any time. Materials and other specifications may vary. Square footages are approximate. Pricing may change at any time, and McMillin Homes reserves the right to increase or decrease home prices from the amounts provided on the website.
DO NOT ENTER THIS PROMOTION IF YOU DO NOT WISH TO DISCLOSE ANY PERSONAL INFORMATION. McMillin Homes will not share, sell, transfer or rent any information submitted by an Entrant.
ADDITIONAL TERMS: Except where prohibited by law: (i) by entering into the Sweepstakes, an Entrant thereby grants permission to use the Entrant's, name, hometown, voice, likeness, photograph, and any statements regarding this Sweepstakes for editorial, public relations, promotional and advertising purposes on behalf of McMillin Homes without compensation; (ii) the Potential Winner will be required to complete and return an Affidavit of Eligibility and Release of Liability/Publicity within ten (10) days of notification of winning the Sweepstakes or an alternate winner may be selected by random drawing to be conducted in accordance with the rules set forth for the Drawing. If winner notification is returned as undeliverable, an alternate winner may be selected by random drawing to be conducted in accordance with the rules set forth for the Drawing. By participating and winning the Grand Prize, the Potential Winner releases McMillin Homes and its parents, affiliates, subsidiaries, and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the Sweepstakes. Subject to all U.S. federal, state and local laws and regulations. Void where prohibited. Taxes on prizes are the sole responsibility of the winners. Grand Prize winner will be issued a 1099 tax form.
DISPUTE RESOLUTION: By participating in this Sweepstakes, Entrant agrees to be bound by these Official Rules and the decisions of McMillin Homes. Additionally, Entrant agrees to defend, indemnify, release and hold harmless McMillin Homes and any entity related to the Sweepstakes from and against any and all losses, demands, damages, rights, claims, actions and liabilities of any kind arising out of or related to (i) Entrant's participation in the Sweepstakes, or (ii) Entrant's participation in any prize-related activities (including, without limitation, any property loss, damage, personal injury or death cause to any person(s)).
Except where prohibited by law, Entrants agree: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, awarding of the Grand Prize or the rights and obligations of Entrants and McMillin Homes and its agents, or personal jurisdiction for any matter herunder shall be governed by and construed exclusively in accordance with the laws of the State of California. Additionally, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any Entrant be permitted to obtain awards for punitive, incidental or consequential damages, and (d) any and all rights to have damages multiplied or otherwise increased are hereby waived. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
OTHER: McMillin Homes assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or for any other reason including, but not limited to, incomplete, damaged, misdirected, illegible or lost entries. McMillin Homes reserves the right, in its sole and absolute discretion, to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of these Official Rules. McMIllin Homes further reserves the right, in its sole and absolute discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, for reasons including, but not limited to, infection by computer virus, technical corruption, non-authorized human intervention or force majeure. In the event of cancellation, McMIllin Homes reserves the right to select winners from among all eligible entries received prior to date of cancellation. The use of automated entry systems or any other conduct that impedes the integrity of the Sweepstakes is prohibited. In the event of a dispute regarding online entry, entry will be deemed made by the "Authorized Account Holder" of an established e-mail account associated with the entry. The Authorized Account Holder is deemed the natural person who is assigned the e-mail address by an internet access provide, service provider, or other online organization that is responsible for the assigning e-mail addresses for the domain associated with the submitted e-mail address.
